Kenneth J. We have experience in resolving financial disagreements, drafting trial exhibits, and unraveling complex financial issues for court. We know that every litigation entails risk, we aim to control that risk and reduce it to a minimum.
In any situation, we would prefer to be hired directly by an attorney or law firm. The reason for this very simple. We treat each situation as a two-step process. First, we want to be hired as a consultant by an attorney or law firm so that our work product and litigation support consulting is covered by the attorney client privilege. If we are hired directly by a litigant, then all our work is discoverable and we do not have any privilege as to our work product, discovery, and consulting. Situations have arisen after we have been hired that might make our discovery detrimental to the party that hired us and as a result they would not want us to testify in their case. If we were hired directly by them and not by their attorney we can be forced to testify about our findings. We are happy to work directly with business owners in fraud and embezzlement cases, but please keep this issue in mind prior to our engagement.
During this phase of our engagement we assist our clients by assessing the financial merits of a case, responding to interrogatories, assessing the work of other experts, and preparing exhibits for trial.
Secondly, after we have concluded our investigation and written our reports, if required, the engagement is changed and we are now hired as your expert for the purpose of providing testimony at depositions, mediation, arbitration, or trial.
